Key Documents Needed to Start a Divorce Filing in Calgary
When beginning the divorce process in Alberta, there are several important documents you will typically need to gather. These help establish your eligibility and provide the court with necessary information.
- Marriage Certificate: A certified copy of your marriage certificate is essential to prove your marital status.
- Statement of Claim for Divorce: This legal form initiates the divorce proceedings and outlines your reasons for seeking a divorce.
- Financial Disclosure Documents: These include recent pay stubs, tax returns, bank statements, and information about assets and debts to help with any financial arrangements.
- Proof of Residency: Documents like utility bills or government-issued ID showing that you or your spouse live in Alberta.
- Children’s Information: If applicable, birth certificates and custody or parenting plans regarding any children involved.
Additional Documents for Finalizing Divorce
As the divorce progresses, additional paperwork may be required for final orders or agreements:
- Separation Agreement: If you and your spouse have agreed on issues like property division or child arrangements, a written agreement may be submitted.
- Parenting Plan: Details on custody, visitation, and decision-making responsibilities for children.
- Affidavits or Sworn Statements: These may support claims or clarify facts in your case.
- Divorce Order: Once granted, this document finalizes the end of your marriage.
Filing for Divorce When Domestic Violence Is a Concern
If domestic violence has affected your situation, it is important to prioritize your safety throughout the divorce process. While the required documents remain largely the same, you might also want to consider including any relevant protection orders or police reports as part of your filing. Keep in mind that courts in Alberta understand the complexities of such cases and may make accommodations accordingly.
It’s often valuable to work with trusted support networks or professionals who can help guide you safely through filing and related decisions. Remember to use a safe device and private browser when researching or submitting sensitive information.
